I write to you with urgency, humility, and hope.
As this letter reaches you, the Justices of the Supreme Court are presently deliberating Trump v. Barbara, No. 25-365, a case that may carry serious consequences for Birthright Citizenship, the 14th Amendment, the Civil Rights Act of 1866, and the future standing of circa 50,000,000, American citizens, US federalized citizens, descendant children, “babies”, of America’s only chattel slaves.
The decision is expected before the end of June, just days before the greatest July 4th Celebration in US history, which means the time to act, speak, pray, and think together is not later. It is now. “NOW, is the Divine Providential appointment of time, even more than ever in our history. It’s the true “fierce urgency of NOW”, as Martin Luther King, Jr., prophesied 63 years ago.
For many years, I have warned that America has not fully understood the original purpose and power of the Civil Rights Act of 1866. Through my dear friend and brother James Spencer, I was first awakened to the extraordinary significance of that Act and the federal citizenship authority it established for the formerly enslaved and their descendants.
Through that same journey, I came to know Professor John Eastman, President Trump’s primary attorney on this matter, who became my mentor and friend long before his representation of President Trump in these 14th Amendment matters.
When President Trump first raised questions concerning Birthright Citizenship in 2015, I immediately recognized that a sleeping matter had been awakened. I also knew that fierce opposition would come, just as fierce opposition came against President Lincoln when he moved against slavery and toward a new birth of freedom.
Now, after years of study, prayer, correspondence, and close examination of Trump v. Barbara, I am convinced that the American people have not yet been properly educated concerning the historical, constitutional, moral, and national consequences now before the Court.
By the grace of GOD, my pro se Amicus Curiae Brief was delivered to the Supreme Court on March 18, 2026—Chaim, life. Whether accepted or rejected, it stands as my effort to ensure that We the People, especially the descendants of the chattel enslaved, are not silent or absent while questions touching our citizenship fate are being weighed in what Dr. Martin Luther King Jr. called the Palace of Justice.
This week, I certified-mailed correspondence to the parties involved in the case and sent priority letters to the Justices themselves. These letters call for what I have named the Great 14th Amendment Moratorium: a temporary pause, suspension, withdrawal, or reconsideration so that America may be educated before adjudication, awakened before consequence, and brought into fuller understanding before any irreversible national judgment is rendered.
My friends, this is not merely a court matter. It is a citizenship matter. It is a historical matter. It is a national security matter. It is a matter touching political, social, economic, and judicial consequences that may reach far beyond what most Americans presently understand.
Therefore, I am asking you, my fellows, to stand with me now. Please read the materials. Please share them with those who have influence, insight, courage, faith, legal understanding, media access, organizational skill, or any other gift that may help secure this moratorium. Whatever talent, wisdom, prayer, platform, or connection GOD has given you, I ask you to bring it forward now.
The issue is not whether every person agrees with every word I have written. The issue is whether a matter of this magnitude should be decided before the nation has been fully educated on the original laws, the historical record, the meaning of federal citizenship, and the possible consequences of getting this wrong.
For forty-one years, from Justiceville to Dome Village, from homelessness advocacy to the Compton Cricket Club, and now to this citizenship appeal, I have tried to stand where conscience required me to stand. This present stand may be among the most urgent of all.
As America approaches its 250th year, I believe we are standing before one of those rare moments when future generations may ask what the people did when the question was placed before them. This is that great day that our chattel enslaved ancestors pled to GOD and Jesus/Yeshua, would come to their descendant children.

My friends, the window is narrow. The Justices deliberate. The nation waits. History watches. And we must do what conscience, citizenship, and GOD require while there is still time.
Someday is now here. Someday is this day.
Blessings,
Ted Hayes
