IX. RECOMMENDED PRESIDENTIAL ACTIONS

This memorandum respectfully recommends that the President consider the following actions, all within the constitutional responsibilities of the Executive Branch:

  1. Direct a Constitutional Review. Instruct the White House Counsel and the Attorney General to conduct a comprehensive review of the Executive Branch’s continuing responsibilities under the Reconstruction Constitution and existing Reconstruction statutes.
  2. Examine Existing Authorities. Identify the constitutional, statutory, and administrative authorities presently available to the Executive Branch for the faithful execution of Reconstruction law.
  3. Determine Remaining Executive Duties. Assess whether responsibilities assigned by existing Reconstruction enactments remain unfulfilled or require renewed executive attention.
  4. Coordinate Executive Departments. Where appropriate, direct relevant executive departments and agencies to assist in identifying lawful administrative measures consistent with existing federal law.
  5. Report Findings and Recommendations. Submit a comprehensive report to the President identifying the Executive Branch’s continuing constitutional responsibilities, recommended administrative actions, and any matters that may warrant future consideration by Congress.

These recommendations seek no expansion of presidential authority. They ask only that the Executive Branch fully examine and faithfully execute the constitutional and statutory responsibilities already entrusted to it.
