THE PRESIDENT’S CONSTITUTIONAL DUTY TO COMPLETE THE UNFINISHED WORK OF RECONSTRUCTION
This memorandum respectfully submits that the President of the United States possesses an independent constitutional responsibility under Article II to examine and faithfully execute existing Reconstruction law according to its original constitutional purpose.
This is not a request to revisit litigation, challenge judicial authority, or seek new legislation. Rather, it asks whether the Executive Branch has fully discharged its own continuing constitutional obligations under laws enacted to preserve the Union, secure the results of the Civil War, and complete the Nation’s Reconstruction.
The central question is not whether the Reconstruction Amendments remain part of the Constitution. They unquestionably do. The question is whether the Executive Branch has fully examined and exercised the lawful authorities and responsibilities those enactments continue to impose.
The Constitution assigns to each branch of government distinct responsibilities. The President’s oath is to preserve, protect, and defend the Constitution of the United States, and Article II requires that the laws be faithfully executed. That duty is independent of, and complementary to, the responsibilities assigned to Congress and the Judiciary.
This memorandum presents historical evidence, constitutional text, and existing federal law suggesting that significant portions of the Nation’s original Reconstruction mission remain incomplete. It further proposes that the President direct an executive review of those responsibilities, determine what duties remain under existing law, and implement any lawful executive actions necessary to fulfill them.
The objective is not to reopen the past, but to strengthen the constitutional order by ensuring that the Executive Branch faithfully executes the laws enacted to preserve the Union and secure the constitutional settlement that followed the Civil War.
Respectfully submitted, this memorandum seeks only that the President consider whether completing the unfinished work of Reconstruction is not simply a matter of history, but an ongoing constitutional responsibility entrusted to the Office of the President.
